Terms of Service

1. Acceptance of Terms
By creating an account or using the Service or Device, you agree to these Terms. If you do not agree, do not use the Service.

2. Definitions
- "Company" means iFactory Co., Ltd.
- "Service" means the Water-N mobile application and related services
- "Device" means Water-N hardware products
- "User" means any person using the Service
- "Data" includes water quality, temperature, and device usage data, and all Personal Information as defined in the Privacy Policy, including account data, location data, usage logs, and other information that identifies or is reasonably linkable to you
- "Personal Information" means information that identifies or is reasonably linkable to a specific individual

3. Eligibility
- You must be at least 13 years old
- Users aged 13-17 may use the Service. By registering on behalf of a minor aged 13-17, the parent or guardian accepts these Terms on the minor's behalf and is responsible for the minor's compliance
- The Service is not intended for children under 13

4. Account Responsibility
You are responsible for your account and all activities under it.
The Company is not liable for unauthorized use unless caused by its own negligence.

5. Service Availability
The Service is provided "AS IS" and "AS AVAILABLE."
The Company may modify or suspend the Service with reasonable notice where practicable.
If the Service is permanently discontinued, the Company will provide at least 30 days' prior notice.
The Company will make reasonable efforts to allow Users to export their data where feasible.

6. Device and Data Disclaimer
The Device provides water-related data for informational purposes only.
The Company does not guarantee accuracy, reliability, or completeness.
Do not rely solely on the Device for safety or health decisions.

7. No Health or Safety Warranty
The Device does not guarantee water safety and is not a medical device.
Use at your own risk.

8. Product Liability
Nothing in these Terms limits liability for:
- Personal injury or death
- Product defects
- Gross negligence or willful misconduct
where such limitation is prohibited by law.

9. Limitation of Liability
To the maximum extent permitted by law:
- No liability for indirect or consequential damages
- Total liability limited to the greater of:
  USD $100
  Amounts paid in the last 12 months
This limitation does not apply where prohibited by law.

10. Disclaimer of Warranties
The Service is provided without warranties, except as stated below.

Limited Device Warranty:
The Device is warranted for 12 months against defects. The Company will repair or replace defective devices.
Implied warranties, to the extent permitted by applicable state law, are limited in duration to the 12-month warranty period.
We will provide firmware and software updates necessary for basic device functionality for a minimum of 2 years from the date of purchase.
Some states do not allow limitations, so certain rights may vary.

11. User Conduct
You agree not to misuse the Service or violate laws.
Violations may result in suspension or termination with notice where appropriate.

12. Intellectual Property
All rights in the Service belong to the Company.
User content grants a non-exclusive license solely for operating and improving the Service.

13. Indemnification
You agree to indemnify and hold harmless the Company from third-party claims arising from your misuse of the Service or violation of these Terms.
This does not apply to claims arising from the Company's own negligence, product defects, or willful misconduct.

14. Termination
You may terminate your account at any time.
The Company will delete Personal Information within 45 days for California residents, and within a commercially reasonable time for other users.

15. Dispute Resolution
Except for claims that cannot be subject to arbitration under applicable law, disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Key Terms:
- No class actions
- Arbitration conducted locally or remotely

Fees:
Arbitration fees and costs shall be allocated in accordance with the AAA Consumer Arbitration Rules and applicable law. The Company will pay fees to the extent required by those rules or applicable law.

Exceptions:
- Small claims court
- Injunctive relief
- Public injunctive relief claims that cannot be waived

16. Governing Law
These Terms are governed by the laws of the State of Delaware.

17. Severability
Invalid provisions will be modified to remain enforceable. The rest remain in effect.

18. Changes to Terms
Material changes will be notified at least 30 days in advance. Continued use constitutes acceptance.

19. Privacy and Data Use
Use of the Service is subject to the Privacy Policy, including our email communication and marketing opt-out practices as described therein: http://www.water-n.co.kr/watern/privacy_en

20. California Consumer Rights
California residents have rights including access, deletion, and correction of Personal Information.

21. Children's Privacy
The Service is not directed to children under 13. If such data is collected, it will be deleted.
